The best practice is to have a written contract that outlines each parties’ duties and expectations. Alternatively, if presented with a contract or purchase order, it is very wise to hire Briana Cooper to review that contract prior to signing it. 

Unfortunately, a few clients over the years have gotten in trouble by having “verbal agreements” or by signing contracts they failed to read prior to signing. Do not fall into these traps. Mechanic Lien Laws and Payment Bond Claims

If you’re a subcontractor or supplier, you need to be aware of mechanic lien laws and payment bond claims. Both have specific deadlines for sending in your notice of non-payment. Under the Texas Property Code, you are required to send in your pre-lien notice by a particular date and the deadline is even shorter for residential projects. Likewise, under the Texas Government Code, you have deadlines for submitting your payment bond claim. 

If you are having payment issues on a Texas construction project, do not hesitate to contact me!  The deadlines are earlier than what you probably think or have been told. Do not go off of what you are being told in the field, as the laws often change and the deadlines and requirements may be different than what you are being told from friends.
